18 Deciding applications

(1)

The chief executive must consider the application and decide to—

(a)

approve the application; or

(b)

refuse the application.

(2)

In deciding the application, the chief executive—

(a)

must consider the matters prescribed by regulation; and

(b)

may, subject to section 15, consider any other matter the chief executive considers relevant.

(3)

Without limiting subsection (1)(b), the chief executive may refuse the application—

(a)

if satisfied—

(i)

the applicant is not an appropriate person to hold the accreditation; orNote—

For an application made by a partnership, see also section 136.

(ii)

it would not be in the public interest for the applicant to hold the accreditation; or

(b)

on another ground prescribed by regulation.
