Staff’s rights and entitlements
73 Staff’s rights and entitlements
This section applies to a person who immediately before the commencing day was a staff member of a former corporation.
On the commencing day, the person is taken to be employed by the continuing corporation for the former corporation on the same conditions on which the person was employed by the former corporation.
In addition, the person—
keeps all rights accrued or accruing to the person as a staff member of the former corporation; and
is entitled to receive long service, recreation and sick leave and any similar entitlements accrued or accruing to the person as a staff member of the former corporation.
Also, if the person is a member of the superannuation scheme under the Superannuation (State Public Sector) Act 1990—
the person keeps all entitlements accrued or accruing to the person as a member of the scheme; and
the person’s membership of the scheme is not affected.
