Victims of Crime Assistance Act 2009

New chapter 3, part 15, division 1 applies in relation to an application for amendment of a grant of assistance decided on or after the commencement, regardless of whether the act of violence was committed before or after the commencement.

Subsection (3) applies if—

a proportion of an assistance limit was granted before the commencement to another victim of the act of violence; and

the assistance limit would have applied to the applicant had the amending Act not commenced.

Despite subsection (1), for considering and deciding the application—

section 103(2)(c) applies as if it refers to previous section 85 and new sections 86 and 87; and

previous section 104(3) applies.
