27B Deciding application to amend water licence by removing water storage condition
This section applies in relation to an application to amend a water licence (the existing licence) by removing a water storage condition of the licence.
If the chief executive grants the application, the chief executive must grant to the applicant a water licence (the separate licence) to take overland flow water.
The separate licence—
must authorise the taking of overland flow water only from the location at which water was taken or interfered with under the existing licence; and
must state the purpose for which water may be taken under the separate licence, which must be either—
rural; or
any; and
must state at least 1 of the following for the separate licence—
the maximum rate;
the maximum volume of water to be stored in existing overland flow works used to take overland flow water under the licence;
the volumetric limit;
the mean annual volume; and
may state conditions under which overland flow water may be taken under the separate licence.
