79 Granting water licences
This section applies if, under section 36 of the Act, a chief executive’s notice requires the owner of land who is authorised under section 78(1) to take groundwater using an existing water bore to notify the chief executive of the bore and the water use.
After the chief executive receives the notice, the chief executive may, under section 116 of the Act, grant a water licence to the owner to take groundwater using the bore.
In deciding the annual volumetric limit for the licence, the chief executive must have regard to—
the water taking capacity of the bore; and
the annual volume of groundwater estimated by the chief executive to have been taken during the period, of not more than 10 years, immediately before the commencement; and
the efficiency of the use of the water mentioned in paragraph (b); and
the impact on surface water flows; and
data collected by the chief executive about groundwater levels; and
whether the amount of water to be taken under the licence is consistent with the outcomes mentioned in part 3 and the objectives of this plan.
