118 Chief executive may give notice of suspected faulty measurement device
This section applies if the chief executive suspects the measurement device is faulty.
The chief executive may give the holder of the relevant authorisation a notice stating—
that the chief executive suspects the measurement device is faulty; and
that the holder of the authorisation must within 30 business days after the notice is given or a longer period agreed to by the chief executive—
rectify the fault and ensure a duly qualified person certifies the device as complying with the measurement standards; or
replace the device with another measurement device that is certified by a duly qualified person as complying with the measurement standards; or
if the device is found not to be faulty—ensure a duly qualified person certifies the device as complying with the measurement standards.
The holder of the relevant authorisation must comply with a notice given to the holder under subsection (2), unless the holder has a reasonable excuse.Maximum penalty—20 penalty units.
