For section 39(c) of the Act, the criteria for establishing the elements of proposed water allocations to be granted on conversion from a water entitlement or other authorisation (each an existing authorisation) are—

to the extent a relevant water plan applies the criteria stated in subdivision 2 or 3—the criteria; and

any criteria in a relevant water plan for converting an existing authorisation to a water allocation.

If there is an inconsistency between criteria mentioned in subsection (1)(a) and criteria mentioned in subsection (1)(b), the criteria mentioned in subsection (1)(b) prevail.
