Weapons Act 1990

If a person is a licensee and is named as the respondent in a temporary protection order, police protection notice or release conditions, the licence is suspended while the order, notice or conditions are in force.

If a person is a body’s representative and is named as the respondent in a temporary protection order, police protection notice or release conditions—

any authority the respondent has to possess a weapon because the respondent is the body’s representative is ineffective while the order, notice or conditions are in force; and

the body’s licence is suspended 7 days after the licensee is given the order, notice or conditions unless, in that period, another individual is endorsed on the licence as the body’s representative in substitution for the respondent.

Subsections (1) and (2)(a) take effect—

if the respondent is present in court when the temporary protection order is made—from the time of the order; or

otherwise—when the respondent is given the order, notice or conditions.

A suspension under subsection (2)(b) ends on the earlier of the following—

when another individual is endorsed on the licence as the body’s representative in substitution for the respondent;

the order, notice or conditions are no longer in force.

Subsections (1) and (2)(a) stop having effect when the order, notice or conditions are no longer in force.

If the licensee of a licence suspended under subsection (1) or (2)(b) holds a permit to acquire, the permit is also suspended while the licence is suspended.

Despite a suspension under this section, an authorised officer may suspend the licence under section 28.
