Weapons Act 1990

If a person is a licensee and is named as the respondent in a protection order or police protection direction, the licence is revoked.

If a person is a body’s representative and is named as the respondent in a protection order or police protection direction—

any authority the respondent has to possess a weapon because the respondent is the body’s representative is ineffective; and

the body’s licence is suspended 7 days after the day the licensee is given the protection order or the direction takes effect unless, in that period, another individual is endorsed on the licence as the body’s representative in substitution for the respondent.

Subsections (1) and (2)(a) take effect—

if the respondent is present in court when the protection order is made—on the making of the order; or

if the respondent is present when a police officer issues and explains the police protection direction—when the police officer issues the direction; or

otherwise—when the respondent is given the protection order or is personally served with the direction.

A suspension under subsection (2)(b) ends on the earlier of the following—

when another individual is endorsed on the licence as the body’s representative in substitution for the respondent;

the protection order or police protection direction is no longer in force.

If the licensee of a licence revoked under subsection (1) or suspended under subsection (2)(b) holds a permit to acquire, the permit is revoked or suspended while the licence is revoked or suspended.

Despite a suspension under subsection (2)(b), an authorised officer may suspend the licence under section 28.
