Reasons for decisions must address certain matters—Act, ss 540 and 546

(1)

For sections 540(4)(a) and 546(3AA) of the Act, the reasons for a decision must address the following matters—

(a)

citation of the provision of the Act under which the decision is made;

(b)

a statement of—

(i)

the evidence considered for the decision; and

(ii)

the evidence that was accepted or rejected for the decision and why the evidence was accepted or rejected; and

(iii)

the conclusions drawn from the evidence; and

(iv)

the link between the evidence, the conclusions and the provision of the Act under which the decision is made; and

(v)

the decision made.

(2)

Also, the reasons for a decision must be written in plain English.
