Biosecurity Act 2025

A person is not guilty of an offence under this Act because of a dealing with any biosecurity matter, carrier or potential carrier in the ordinary course of business as a common carrier.

The regulations may—

declare that a person or a class of persons is a common carrier for the purposes of this section; and

declare that a person or a class of persons is not a common carrier for the purposes of this section.

This section does not apply in relation to—

an offence against section 33, section 123, section 183(6), section 196(5) or section 211(5);

or

an offence of contravening an individual biosecurity direction; or

an offence against Part 15;

or

an offence excluded from the operation of this section by the regulations.
