Burden of proof in certain circumstances

In proceedings for an offence under this Act, the burden is on the defendant to prove—

(a)

that the defendant was exempt from a requirement imposed by or under this

Act; or

(b)

that the defendant was authorised by or under this Act to engage in any conduct so engaged in by the defendant (including on account of being a permit holder under Part 8).
