39 Privilege against legal proceedings abolished
No member of the Parliament shall be entitled to set up or claim any of the privileges, immunities, or powers to which the member may be entitled by virtue of the last preceding section, as against any summons, subpoena, writ, order, process, or proceeding whatsoever issued by any court of law within the said province: Provided that—
no writ of capias ad satisfaciendum shall be executed or put into effect against any such member during any session of Parliament, or within ten days prior to the meeting thereof; and
no member shall be liable to any penalty or process for non-attendance as a witness in any court when such non-attendance is occasioned by the member's attendance in the member's place in Parliament.
