34 Powers of entry and inspection
An authorised officer, may, for the purposes of this
Act—
enter at all reasonable times, inspect and examine any site where building or construction work is being carried out;
conduct any examination or inquiry necessary to ascertain whether this Act has been complied with;
require the production of any document relevant to the calculation or payment of any levy under this Act, inspect and examine it, and take copies or extracts from it.
A person who obstructs or hinders an authorised officer in the performance of the officer's duty is guilty of an offence. Maximum penalty: $10 000.
A person who gives false or misleading information to an authorised officer in the performance of the officer's duty is guilty of an offence. Maximum penalty: $10 000.
A person is not excused from answering a question or producing a document when required to do so under this Act on the ground that to do so might tend to incriminate the person or make the person liable to a penalty.
However, if the person objects to answering the question or producing the document on that ground, the answer or document is not admissible against the person in any criminal proceedings other than—
proceedings for an offence with respect to false or misleading statements, information or records; or
proceedings for an offence in the nature of perjury.
