36 Prosecution
Proceedings for an offence against this Act may be instituted—
by the Director of Public Prosecutions; or
in relation to any offence of a prescribed kind—by the Board or any person authorised to do so by the Board.
Proceedings for an offence against this Act must be commenced within three years after the date on which the offence is alleged to have been committed.
Where, in proceedings for an offence against this Act, the court finds that the defendant has contravened, or failed to comply with, this Act, the court may, in addition to any penalty that it may impose—
order the defendant to take specified action to make good the contravention or default in a manner, and within a period, specified by the court;
order the defendant to furnish or make available to the Board, within a period specified by the court, such information or records as the
Board may reasonably require for the purposes of this Act.
