45 Proceedings for offences
Proceedings for a summary offence against this Act may only be commenced by—
an authorised officer; or
a
Competent Authority.
Proceedings for a summary offence against this Act must be commenced—
in the case of an expiable offence—within the time limits prescribed for expiable offences by the Summary
Procedure Act 1921;
in any other case—within three years of the date on which the offence is alleged to have been committed or, with the authorisation of the
Attorney-General, a later time within six years of that date.
A document apparently signed by the Attorney-General and stating that the Attorney-General authorises a specified extension of the period for commencing a particular prosecution is to be accepted, in the absence of proof to the contrary, as proof of the fact so stated.
