26 Removal of judicial officer

(1)

Subject to subsection (2), if a judicial conduct panel concludes that removal of a judicial officer is justified, the Governor may remove the judicial officer from office.

(2)

If the judicial officer is a judge who is liable to be removed from office, pursuant to the Constitution

Act 1934 or any other Act or law, on an address from both Houses of Parliament, subsection (1) does not apply (but the judge may be removed from office on such an address from both Houses of Parliament under the

Constitution Act 1934 or other Act or law).

(3)

To avoid doubt, the power to remove a judicial officer under this section may be exercised despite any other provision for the removal of the judicial officer under the Act under which the judicial officer was appointed.
