40 Competition authorisation
Relevant conduct is conduct that is specifically authorised by these regulations for the purposes of the Competition and Consumer Act 2010 of the Commonwealth and the Competition Code of South Australia.
Conduct authorised by this regulation is authorised to the extent, if any, that it would otherwise contravene Part IV of the
Competition and Consumer
Act 2010 of the Commonwealth and the
Competition Code of South
Australia.
In this regulation—
giving effect to a requirement includes—
complying with an obligation arising in connection with the requirement; and
exercising or enforcing a right or power arising in connection with the requirement;
relevant conduct means the following conduct:
entering into negotiations, or entering into a contract, under regulation 23;
entering into negotiations, or entering into a contract, under regulation 24;
giving effect to a requirement under a FERM contract;
exercising a function in relation to, or giving effect to a requirement in relation to, any other matter under these regulations by a scheme entity.
