Injunction to refrain from conduct pending investigation
20A Injunction to refrain from conduct pending investigation
The Supreme Court may, on application made by the Ombudsman (in a case where section 19A does not apply or the Ombudsman does not consider it appropriate to issue a notice under that section), grant an injunction restraining a person from engaging in conduct that is the subject of, or affects the subject matter of, an investigation or proposed investigation by the Ombudsman.
The Supreme Court must not grant an injunction under this section unless it is satisfied—
that the conduct sought to be restrained is likely to impede the investigation or proposed investigation; or
that it is necessary in the public interest to do so.
