Part 7 of the Act, as modified by subclause (2), applies in relation to an employee of the Education and Early Childhood Services Registration and Standards Board of South Australia (the Board) under theEducation and Early Childhood Services (Registration and

Standards) Act 2011 if—

the employee is bound by—

the S.A. Public Sector Salaried Employees Interim Award;

or

the South Australian Public Sector Enterprise Agreement:

Salaried 2021; or

the employee is employed in executive level administrative duties.

For the purposes of subclause (1), Part 7 of the Act is modified as follows:

sections 42, 45(3), 46, 54(2) and 54(3) do not apply in relation to an employee of the Board;

section 48 is taken to be modified such that each employee of the Board is, when engaged as an employee of the Board, at first on probation for 12 months, unless the Board determines that no probation is required or determines a lesser period of probation.
