16 Appointment by court as trustee of amount of judgment etc

(1)

If a court orders the delivery or transfer of property to a person, the court may direct that the property be delivered or transferred to the

Public Trustee on behalf of that person.

(2)

The Public Trustee must accept delivery or transfer of the property (and the acceptance is a sufficient discharge to the person delivering or transferring the property).

(3)

The Public Trustee must hold the property on trust to apply it, and its income, in the manner and for the benefit of persons as the court may from time to time direct.

(4)

Subject to direction by the court, the Public Trustee has all the rights and powers, and must undertake all the duties and liabilities, of a trustee (subject to this Act) in relation to the property.

(5)

In this section—

court means any court, or person acting judicially, exercising jurisdiction either within or outside the

State.
