79 Referral report
The Commissioner or an authorised person is to provide the Tribunal with a report relating to any complaint referred to the Tribunal.
A referral report relating to a complaint is to be provided within 48 days after the complaint is referred to the Tribunal.
The following matters are to be addressed in a referral report:issues raised in the complaint that remain unresolved; a description of the complaint; any amendments that were made to the complaint; application of exemptions and exceptions under Part 5; admitted facts; facts to be established; witnesses to be called; documents to be provided; any material evidence to substantiate the complaint or to support the position of the respondent; attempts at resolving the complaint by conciliation, excluding details of the matters discussed during the attempts.
A report is not to set out or describe anything said or done in the course of conciliation or other complaints resolution proceedings under Division 3.
The Commissioner or an authorised person is to give a copy of the report to the complainant and the respondent.
