A biosecurity undertaking does not prevent the taking or continuation of proceedings for an offence under this Act in respect of any matter that is the subject of the undertaking.

Despite subsection (1), compliance with a biosecurity undertaking may be taken into account as part of proceedings for an offence under this Act in respect of any matter that is the subject of the undertaking.
