179 Cancellation of registration of individual non-government school
The Registration Board may cancel the registration of an individual non-government school – if satisfied that – the school no longer meets the standards for registration of an individual non-government school; or the school or its governing body is not complying with any condition to which the registration is subject; or the school's governing body has failed to comply with a direction given to it under section 194; or it is in the best interests of the students at that school to do so; or if the school's governing body notifies the Registration Board, in writing, that the school will have no enrolments for a specified period of time; or for any reason prescribed by the regulations.
In determining whether or not to cancel the registration of a registered individual school, the Registration Board – is to consider any reports provided by the Registrar under Division 6 in relation to the school; and may take into account any information it considers relevant; and is to allow the governing body of the school a reasonable opportunity to make written submissions in relation to the matter; and must consider any such submissions.
On cancelling the registration of a registered individual school, the Registration Board, in writing, is to notify – the governing body of the school of – the cancellation; and the date on which the cancellation takes effect; and the reasons for the cancellation; and the Minister of the cancellation and the date on which it takes effect.the Secretary of the department of the Commonwealth government having responsibilities in relation to education and training of the cancellation and the date on which it takes effect.
The cancellation of the registration of a registered individual school takes effect on the day specified in the notice provided to its governing body under subsection (3).
