Integrity Commission Act 2009

The Integrity Commission may, having regard to the principles stated in section 9 – assess, investigate, inquire into or otherwise deal with complaints relating to serious misconduct by a police officer in accordance with Parts 6 and 7; or provide advice in relation to the conduct of investigations by the Commissioner of Police into police misconduct; or audit the way the Commissioner of Police has dealt with police misconduct, in relation to either a particular complaint or a class of complaint; or assume responsibility for and complete in accordance with Parts 6 and 7 an investigation commenced by the Commissioner of Police into misconduct by a police officer.

If requested by the Integrity Commission, the Commissioner of Police is to give the Integrity Commission reasonable assistance – to undertake a review or audit; or to assume responsibility for an investigation.

If the Integrity Commission assumes responsibility for an investigation, the Commissioner of Police must stop his or her investigation or any other action that may impede the investigation if directed to do so by the Integrity Commission.
