This section applies to a person who is or has been – a member of the Board; or the Parliamentary Standards Commissioner; or an officer or employee of the Integrity Commission; or a person authorised or appointed under section 21 to undertake work on behalf of the Integrity Commission; or an assessor or investigator; or a member of the Joint Committee; or a member of an Integrity Tribunal; or an inquiry officer or other person appointed to assist an Integrity Tribunal.
A person to whom this subsection applies must preserve confidentiality in respect of all matters that come to the person's knowledge in the course of employment or duties under this Act and if the person discloses, without authorisation from the Board, the chief executive officer or an Integrity Tribunal, any information as to matters of that kind to any person, except – as may be required in connection with the administration or operation of this Act; or as may be required in connection with any proceedings under this Act, any other written law or the Criminal Code; or as authorised by the Board, the chief executive officer or an Integrity Tribunal; or to any other prescribed person – the person is guilty of an offence. Fine not exceeding 5 000 penalty units or imprisonment for a term not exceeding 2 years.
