21 Referral of planning approval process to Commission by Minister
If a specified planning authority or a combined planning authority fails to fulfil any of its obligations under this Act and does not remedy that failure within 14 days of being required by notice in writing from the Minister to do so, the Minister may by order declare that the planning approval process in respect of the major infrastructure project is to be administered by the Commission.
If the Minister determines that – a combined planning authority has become unworkable; and the situation cannot be suitably remedied using the Minister's powers under section 16 – the Minister may by order dismiss the members and deputy members of the combined planning authority and declare that the planning approval process in respect of the major infrastructure project is to be administered by the Commission.
The Minister must cause an order under this section to be laid before each House of Parliament within the first 10 sitting days of the House after the order is made together with a statement of the Minister's reasons for making the order.
