86 Exemption from conditions of mining lease
A lessee may apply to the Minister for an exemption from any condition of a lease.
An application is to be – in an approved form; and accompanied by the prescribed fee; and lodged with the Registrar.
The Minister may – grant the application; or refuse to grant the application.
If the Minister grants an application, the Minister is to issue the lessee with a certificate of exemption.
A certificate of exemption – remains in force for the period specified in the certificate; and is subject to any conditions specified in the certificate.
