In force
Part 8Insurance

100 Owner or occupier may be required to comply with requirement to ensure that insurance may be obtained on reasonable terms

If the body corporate is unable to obtain insurance for a building or part of it on reasonable terms because – the owner or occupier of a lot is carrying on a particular activity on the lot; or work is required in relation to the lot to reduce the insurance risk to a reasonable level – the body corporate may, by written notice given to the owner, require the owner to ensure that the activity ceases or to have the work carried out (as the case requires).

A notice under this section must give the owner the option of paying any additional insurance premium payable in the event of the continuance of the activity, or the non-performance of the work.
