101 Approval of Minister required for removal of rail infrastructure

Despite any other provision of this Act, including section 84(1), rail infrastructure may not be removed from a corridor, or from a part of a road that extends between parts of a corridor, except with the approval of the Minister.

The Minister may only issue an approval under subsection (1) in relation to the removal of rail infrastructure if, where a permit is required under the Land Use Planning and Approvals Act 1993 in relation to the removal of the rail infrastructure, such a permit has been granted under that Act in relation to the proposed removal.
