23 Transfer of Crown land
The Minister, by notice published in the Gazette, may transfer Crown land specified in the notice to TasTAFE if – the Treasurer and the Minister administering the Crown Lands Act 1976 approve that transfer; and TasTAFE has agreed to the transfer of the land.
On the day on which a notice under subsection (1) takes effect, the Crown land specified in the notice vests in TasTAFE – subject only to those estates in the land specified in the notice; or if the notice does not specify that the land vests subject to an estate, free from all encumbrances.
On the recommendation of the Minister, the Treasurer, by notice in the Gazette, may exempt TasTAFE from any liability to pay any State charges, taxes or duties specified in the notice in respect of the vesting of land under this section.
A notice under subsection (1) or (3) – takes effect on the day on which it is published in the Gazette or such later day as is specified in the notice; and is not a statutory rule for the purposes of the Rules Publication Act 1953.
