121 Compliance with vehicle defect notice

If a major vehicle defect notice (other than one imposing a total prohibition on the use of the vehicle) is not complied with within the period for compliance, a person must not use the vehicle to which the notice relates on a public street. Fine not exceeding 20 penalty units.

If a minor vehicle defect notice is not complied with within the period for compliance, a person must not use the vehicle to which the notice relates on a public street. Fine not exceeding 20 penalty units.

A person must not use a vehicle in respect of which a vehicle defect notice has been issued contrary to a condition of the notice. Fine not exceeding 20 penalty units.

Subregulation (3) does not prevent the use of a vehicle, after a defect identified in a vehicle defect notice has been remedied, for the purpose of obtaining clearance of the notice.

A person must not permit the use of a vehicle contrary to this regulation. Fine not exceeding 20 penalty units.
