17 Offence to contravene an order
(1)
A person is guilty of an offence if the person—
(a)
cultivates a GM crop in contravention of an order or otherwise contravenes an order; and
(b)
does so knowing that, or reckless as to whether, the crop or crop related material to which the contravention relates is a GM crop or GM crop related material.
(2)
A person who is guilty of an offence against subsection (1) is liable to a fine not exceeding—
(a)
240 penalty units in the case of a natural person; or
(b)
1200 penalty units in the case of a body corporate.
