18 Offence by gene technology provider

(1)

A person (the gene technology provider) is guilty of an offence if the gene technology provider—

(a)

makes, develops, produces or manufactures a GMO; and

(b)

sells or gives the GMO to another person; and

(c)

knows or reasonably ought to have known or has reasonable cause to believe that the other person intends—

(i)

to use the GMO to cultivate a GM crop in contravention of an order; or

(ii)

to sell or give the GMO to a third person for use by that third person to cultivate a GM crop in contravention of an order.

(2)

A gene technology provider who is guilty of an offence against subsection (1) is liable to a fine not exceeding—

(a)

240 penalty units in the case of a natural person; or

(b)

1200 penalty units in the case of a body corporate.
