9A Meaning of serious criminal activity
Conduct—
that has been engaged in; and
that constitutes an applicable offence—
is serious criminal activity for the purposes of this Act.
For the purposes of subsection (1), it does not matter—
whether the conduct constitutes more than one applicable offence; or
whether the conduct occurred before or after the commencement of this section; or
whether a person has been charged with an applicable offence in relation to that conduct; or
whether any prosecution for such an offence has concluded with an acquittal or a finding of guilt or in any other way.
Conduct that would constitute an applicable offence if it were to be engaged in is also serious criminal activity for the purposes of this Act.
For the purposes of subsection (3), it does not matter whether the conduct would constitute more than one applicable offence.
