1 The Act may also specify a provision of the Act as a civil penalty requirement for the purposes of the Essential Services Commission Act 2001.
2 If a provision of the Act that was specified as a civil penalty requirement in the Act ceases to be specified as a civil penalty requirement in the Act, the provision is not a civil penalty requirement even if it is specified in Schedule 2, unless it is specified in Schedule 1.
