Land Acquisition and Compensation Regulations 2021

Within 3 months after service of the offer of compensation, you must do one of the following—

You may accept the offer but leave some matters to be negotiated. You may also accept the offer and make a claim for further compensation if you believe that you are entitled to it.

If you want to accept the offer as full compensation for your interest in the land acquired (without any further negotiation or claim for compensation), you should complete Part A of Form 11.

If you want to accept the offer but also want to claim further compensation or negotiate other matters with the [name of Authority], you should complete Part B of Form 11.

If you reject the offer completely and make a claim for compensation, you should complete Part C of Form 11.

Please note that all claims for compensation should clearly state the amount of compensation you claim to be entitled to, the type of loss to which each part of the claimed compensation relates, and be accompanied by all relevant supporting material or documents to substantiate your claim. The [name of Authority] may ask for further information from you when assessing your claim or if there are matters to be negotiated.

If you do not reply within time, the [name of Authority] may assume that you reject the offer and dispute it. A dispute is determined by the Victorian Civil and Administrative Tribunal or by the Supreme Court.

If you need more time to decide what to do, you must ask the [name of Authority] for an extension. This request should be made as soon as possible. If the [name of Authority] will not let you have more time, you can ask the Minister responsible for administering the Land Acquisition and Compensation Act 1986 for more time; see section 106 of that Act.
