10 Coastal protection structures—demolition

(1)

A Crown land manager responsible for marine and coastal Crown land on which a coastal protection structure is situated has a prescribed consent to demolish the coastal protection structure if—

(a)

the Crown land manager is satisfied that—

(i)

there is an immediate risk to public health or safety or the marine and coastal environment; and

(ii)

the Minister has not given a consent to install the coastal protection structure under section 70 of the Marine and Coastal Act 2018; and

(b)

the purpose of the demolition is to minimise the immediate risk referred to in paragraph (a)(i).

(2)

It is a prescribed condition of a consent referred to in subregulation (1) that the Crown land manager must give written notice to the Department of the completion of the coastal protection structure's demolition as soon as practicable after the demolition is completed.
