33A Refund of fees for registration holders
The Chief Commissioner, in accordance with subregulation (2), may refund, in whole or in part, the registration fee or the renewal fee paid for a private security registration if the Chief Commissioner grants an application by the holder of the registration for—
a private security business licence that authorises the provision of services of other persons to carry on a security activity authorised under the registration; or
a private security individual operator licence that authorises the carrying on of a security activity authorised under the registration; or
the variation of a private security business licence to authorise the provision of services of other persons to carry on a security activity authorised under the registration; or
the variation of a private security individual operator licence to authorise the carrying on of a security activity authorised under the registration.
The amount of a refund under subregulation (1) must be calculated in accordance with the following formula—
where—
R is the amount of the refund (in dollars);
A is the unexpired number of days of the registration's duration as at the date of the decision to grant the application;
B is the total number of days for which the registration was granted or renewed;
C is the amount of the registration fee or the renewal fee paid for the registration (in dollars).
In this regulation—
private security registration has the same meaning as in section 3 of the Act as in force immediately before the commencement of Part 2 of the Private Security and County Court Amendment Act 2024.
