33D Reduction, waiver or refund of fees in exceptional circumstances
(1)
If the Chief Commissioner considers that there are exceptional circumstances justifying doing so, the Chief Commissioner may—
(a)
refund, in whole or in part, any fee paid under the Act; or
(b)
reduce or waive any fee payable under the Act.
(2)
In deciding whether to reduce, waive or refund a fee under subregulation (1), the Chief Commissioner must have regard to the following—
(a)
whether payment of the fee or part of the fee has caused, or would cause, undue financial hardship;
(b)
whether payment of the fee or part of the fee has been, or would be, manifestly unfair.
