13AB What is a police detention decision?
A police detention decision is a decision made in relation to a person that authorises—
(a)
the taking into custody of the person (unless the person is already being detained under a preventative detention order or an order for the person's detention made under a corresponding preventative detention law); and
(b)
subject to this Part, the detention of the person under this Part for a period not exceeding the maximum police detention period which—
(i)
starts when the person is first taken into custody under section 13AH(2)(a) or detained under section 13AH(2)(b); and
(ii)
ends under Division 9.
