40 Acts done by trustees prior to transfer of patriotic fund validated
Subject to subsection (2), if any patriotic fund or any part of a patriotic fund is transferred to and vested in the trustees of any other patriotic fund—
all acts, matters and things done by the trustees; and
all payments made by the trustees—
with respect to, for the administration of, and for the purpose of executing, the patriotic fund that occurred immediately before the transfer, are valid and effectual.
Subsection (1) does not exempt a trustee from civil or criminal liability for any breach of trust or other unlawful act, whether by omission or commission, for which he or she was legally responsible immediately before the fund was transferred.
