39 Certificate of Department Head
A certificate signed by the Department Head certifying that the property, rights and liabilities of the Crown that relate to the Department Head's early childhood services regulator functions specified in the certificate have been allocated under an allocation statement to the Victorian Early Childhood Regulatory Authority is, unless revoked under subsection (2), conclusive evidence—
that the property, rights or liabilities have been so allocated; and
that the property, rights or liabilities have vested in, or have become, the property, rights or liabilities of, the Victorian Early Childhood Regulatory Authority on the relevant date.
If the Minister so directs the Department Head in writing, the Department Head must revoke a certificate given under subsection (1) by issuing another certificate or certificates in place of the first certificate.
The Department Head—
must keep a register of certificates issued under this section; and
must make the register reasonably available for inspection by interested persons.
