15 Criteria for categorisation as migratory species

(1)

A native species is eligible for listing in the category of migratory species at a particular time if, at that time —

(a)

either —

(i)

members of the species periodically or occasionally visit Australia or an external Territory or the exclusive economic zone; or

(ii)

the species is the subject of an international agreement that relates to the protection of migratory species and that binds the Commonwealth;

and

(b)

listing in that category is otherwise in accordance with the ministerial guidelines.

(2)

If a native species is listed in the category of migratory species on the basis of subsection (1)(a)(ii), the listing must specify the relevant international agreement.
