146 Confidentiality
A person who is or has been engaged in the performance of functions under this Act must not, directly or indirectly, record, disclose or make use of any information obtained in the performance of those functions except —
for the purpose of, or in connection with, performing functions under this Act or another written law; or
as required or allowed by this Act or another written law; or
with the written consent of the Minister or the person to whom the information relates; or
for the purpose of any proceeding before a court, the State Administrative Tribunal or the Building Services Board arising out of the administration of this Act, the Building Services (Complaint Resolution and Administration) Act 2011 or the Registration Act; or
in prescribed circumstances.
Penalty: a fine of $25 000.
