147 False or misleading information

(1)

A person must not do any of the things set out in subsection (2) —

(a)

in relation to an application under this Act; or

(b)

in relation to the compliance, or purported compliance, with any requirement or direction under this Act to give information to, or answer a question of, a permit authority, police officer or authorised person.

Penalty: a fine of $25 000.

(2)

The things to which subsection (1) applies are —

(a)

making a statement which the person knows is false or misleading in a material particular; or

(b)

making a statement which is false or misleading in a material particular, with reckless disregard as to whether or not the statement is false or misleading in a material particular; or

(c)

providing, or causing to be provided, information that the person knows is false or misleading in a material particular; or

(d)

providing, or causing to be provided, information that is false or misleading in a material particular, with reckless disregard as to whether the information is false or misleading in a material particular.
