29 Compliance with building or demolition permit
The person named as the builder on a building permit must ensure that —
the building or incidental structure to which the permit applies is completed in accordance with the plans and specifications that are specified in the applicable certificate of design compliance; and
the building work otherwise complies with the building permit including each condition that applies to the permit.
Penalty:
for a first offence, a fine of $50 000;
for a second offence, a fine of $75 000;
for a third or subsequent offence, a fine of $100 000 and imprisonment for 12 months.
The person named as the demolition contractor on a demolition permit must ensure that the demolition work complies with the demolition permit including each condition that applies to the permit.
Penalty:
for a first offence, a fine of $50 000;
for a second offence, a fine of $75 000;
for a third or subsequent offence, a fine of $100 000 and imprisonment for 12 months.
