43 Recovery of costs and expenses of investigation of charitable trust
In this section —
costs and expenses, of an investigation (including any audit of the accounts of a charitable trust under the investigation), means the costs and expenses of an investigator in conducting the investigation.
The Attorney General may apply to the Court to recover the costs and expenses of an investigation.
On an application under subsection (2), the Court may make orders for the payment of the whole or part of the costs and expenses of the investigation —
out of the property of the relevant charitable trust; or
by a trustee of the relevant charitable trust; or
if the investigation was the result of a complaint and the Court finds that the complaint was frivolous or vexatious or was not made in good faith — by the complainant.
