94 False or misleading information
A person —
in making a report under section 11 or 12;
in making a request for a summary of records under section 21;
in making a written submission to the committee under section 37(e);
in making a disclosure statement under section 64, a disclosure under section 68 or in connection with a request for a certificate of contamination audit under section 62; or
in purporting to comply with a requirement made by or under this Act to provide information to the CEO or to the committee,
must not —
make a statement which the person knows is false or misleading in a material particular;
make a statement which is false or misleading in a material particular, with reckless disregard as to whether or not the statement is false or misleading in a material particular;
provide, or cause to be provided, information that the person knows is false or misleading in a material particular;
provide, or cause to be provided, information that is false or misleading in a material particular, with reckless disregard as to whether the information is false or misleading in a material particular; or
fail to disclose, or cause a failure to disclose, all information that the person knows is materially relevant.
Penalty: $125 000, and a daily penalty of $25 000.
