Electricity Industry Act 2004

Civil proceedings cannot be brought in respect of a matter arising under the Pilbara Networks Access Code except —

in accordance with the regulations; or

by arbitration under the Pilbara Networks Access Code; or

in accordance with section 130.

Nothing in subsection (1) affects the right of a person —

to bring civil proceedings in respect of any matter or thing, or seek any relief or remedy, if the cause of action arises, or the relief or remedy is sought, on grounds that do not rely on the Pilbara Networks Access Code; or

to bring proceedings for judicial review of a decision made under this Act or the Pilbara Networks Access Code.
